The fine print, in plain words.

By accessing the site, creating an account, or placing an order, you confirm that you accept these Terms and our Privacy Policy. If you do not agree, please do not use the site or order from us.

You must be the age of majority in your province or state and able to enter a binding contract. If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Provide accurate, current information, and let us know promptly of any unauthorized use.

We try to describe our sauces and show images as accurately as possible, but small variations in colour, packaging, and detail can occur. Items marked "coming soon" are not yet available for purchase. Products are subject to availability and we may limit quantities or discontinue items at any time.

Food information — ingredient, allergen, and dietary labels (for example "vegan," "gluten-free," or "no MSG") are provided in good faith based on our recipes and suppliers. They are general information, not medical advice. If you have a food allergy or sensitivity, please read the label on the jar and consult the ingredient list before consuming.

Prices are listed in Canadian dollars (CAD) and may change at any time before you place an order. Applicable taxes (such as Ontario HST) and shipping are calculated and shown at checkout before you pay. If a price is obviously wrong due to a typographical error, we may cancel the order and refund you, even after it was placed.

Your order is an offer to buy. A confirmation email acknowledges that we received your order; it does not by itself mean we have accepted it. We may refuse or cancel an order — for example, if an item is unavailable, a pricing error occurred, payment cannot be verified, or we suspect fraud — and will refund any amount charged for a cancelled order.

Payments are processed securely by Stripe. By providing payment details, you authorize us (through Stripe) to charge the full order amount, including taxes and shipping. We do not store your full card details. You represent that you are authorized to use the payment method you provide.

From time to time we offer discount or promotion codes (for example, a welcome code for your first order). Unless stated otherwise, codes are for one use per customer, cannot be combined, have no cash value, apply only to eligible items, and may be changed or withdrawn at any time. Any conditions shown with the offer apply.

Shipping options, costs, and estimated timelines are shown at checkout and described on our Shipping page. Delivery estimates are not guarantees. Risk of loss passes to you on delivery to the carrier. For international orders, you are responsible for any customs duties, taxes, or import fees charged by the destination country.

Because we sell food products, returns are handled as described on our Returns page — including what to do if an item arrives damaged. Please review that page; it forms part of these Terms.

Masaya Gourmet commits 10% of its profits to charitable causes, including Gawad Kalinga and KlikMe. This is an ongoing commitment by the business; it is not a fixed per-item donation or a charge added to your order, and the recipients and amounts may change over time.

The site and its content — including text, recipes, photography, graphics, logos, and the Masaya Gourmet name — are owned by us or our licensors and protected by law. You may use the site for your personal, non-commercial shopping. You may not copy, reproduce, or use our content or trademarks without our written permission.

You agree not to misuse the site — including by attempting to breach security or App Check protections, scraping or harvesting data, interfering with its operation, submitting false or fraudulent orders, or using it for any unlawful purpose.

The site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties not expressly stated here, including implied warranties of merchantability and fitness for a particular purpose, and we do not warrant that the site will be uninterrupted or error-free. Nothing in these Terms limits your non-excludable rights under applicable consumer protection law.

To the fullest extent permitted by law, Masaya Gourmet will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless Masaya Gourmet and its team from claims, losses, and expenses arising out of your misuse of the site or your breach of these Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, except where applicable consumer protection law gives you the right to bring proceedings elsewhere.

We may update these Terms from time to time. We will revise the "Last updated" date above, and significant changes take effect when posted. Your continued use of the site or placing a new order after a change means you accept the updated Terms.
